Blue Sky Vacation Rentals (BSVR) – Vacation Rental Agreement

THIS IS A VACATION RENTAL AGREEMENT UNDER THE LOCAL LAWS SPECIFIC TO EACH PROPERTY LOCATION INCLUDING BUT LIMITED TO Vermont, Utah, New York, and Costa Rica. THE RIGHTS AND OBLIGATIONS OF THE PARTIES TO THIS AGREEMENT ARE DEFINED BY LAW AND INCLUDE UNIQUE PROVISIONS PERMITTING THE DISBURSEMENT OF MONIES PRIOR TO USE AND EXPEDITED EVICTION OF GUESTS. YOUR SIGNATURE ON THIS AGREEMENT, OR PAYMENT OF MONEY FOR USE OF THE PROPERTY AFTER RECEIPT OF THE AGREEMENT, IS EVIDENCE OF YOUR ACCEPTANCE OF THE AGREEMENT AND YOUR INTENT TO USE THIS PROPERTY FOR A VACATION RENTAL.

1. PAYMENTS: The amount due at booking your reservation depends on when you make the reservation relative to the Check-in date.  If you make the reservation more than sixty (60) days of your Check-in date, you are required only to pay 60% of the fee. (Bookings through AirBnB may be charged 100% at the time of booking.) For reservations made thirty (30) days or fewer from the anticipated Check-in date, payment in full is required.  Payment may be by bank check or credit card ‒ we accept four major credit cards.  Checks should be made payable to “BlueSky Vacation Rentals LLC.”

A security deposit is NOT charged prior to your arrival date.  Instead, Blue Sky Vacation Rentals (BSVR) retains your credit card information as a Credit Card Hold for ten (10) business days solely to ensure it receives payment for any damages or fines occasioned by your stay at the Property.  Unless other arrangements are made, this card will also be used in the event you have left any items in the home and wish to have them returned to you.  

Your reservation total reflects local tax rates current at the time of the booking2; any changes to those rates by the time of Check-out will be reflected in the final invoice.

2. Cancellations/Changes3. Should you find it necessary to cancel your reservation, your entitlement to all or a portion of the rental fee depends on the timing of your cancellation in relation to the Check-in date as follows:

> 60 Days: Cancellations that are made more than sixty (60) days prior to the Check-in date are eligible for a full refund, less the processing fee, a $95.00 service charge and, if applicable, the Travel Insurance Premium.

60 – 31 Days: Cancellations, or changes shortening the stay, that are made between sixty (60) and thirty-one (31) days ahead of the Check-in date, will be given 50% of the reservation amount paid to date. You will be refunded 50% of all License, Cleaning, and taxes paid. The Credit Card Reservation/Damage Hold will be released. The processing service fee of $95 will still be charged.

< 30 Days: Cancellations, or changes shortening the stay, that are made with fewer than thirty-one (31) days from the Check-in date forfeit all payments. 

Early departure does not warrant a refund.

Email constitutes effective written notice of your cancellation/change and is governed by the timestamp of the email receipt.

All cancellation/change requests must be made through the platform where the original booking was initiated. (example: if booked on VRBO request to change /cancel must be made through VRBO) and, also confirmed through email to info@blueskyvacationrentals.com

We strongly recommend adding travel insurance to protect your investment from unforeseen circumstances such as, sudden illness or inclement weather.

If you booked through Airbnb, VRBO or Marriott, the cancellation policy listed at the time of booking will apply.

3. TRAVEL INSURANCE: Blue Sky Vacation Rentals (BSVR) strongly advises you to obtain travel insurance to protect your vacation investment against the financial consequences of unforeseen circumstances that may compel you to cancel or alter your trip.  To facilitate that, we have contracted with Rental Guardian Travel Insurance (1-888-885-5550) to offer you trip cancellation insurance in exchange for payment of a Travel Insurance Premium. If you elect this insurance, the policy is issued at the same time you book your vacation.  Be advised you do not have coverage in force until both your entire advance rental payment and Travel Insurance Premium are paid in full.  Note that the Premium you pay for the policy is non-refundable after it is in force for fourteen (14) days even if the reservation is cancelled.  Travel insurance is non-transferrable.

Coverage issues are determined exclusively by Rental Guardian Travel Insurance; Blue Sky Vacation Rentals (BSVR) has no role in that determination.  Please see your policy for more specific information.  You may also want to call or contact Rental Guardian directly if you have any questions, or visit Rental Guardian website at  www.rentalguardian.com

If you decline travel insurance, you are accepting full responsibility for the loss of your Vacation Rental Fee in case of ANY unforeseen circumstances including, but not limited to, mandatory evacuations and travel restrictions. 

4. DAMAGE: You are financially responsible for any and all damages occurring to the Property during your stay, whether inflicted by members of your party or a third party you have invited to the Property.  There is no limit to the potential financial responsibility for such damages.  

Upon your departure, Blue Sky Vacation Rentals will inspect the property for damages, including those that may arise from any Special Events pre-approved-by BSVR (such as: family reunions Bridal – wedding parties etc.).  Additional charges may appear on your statement if you:

a.  Damage the residence, its contents, or its environs, ordinary wear and tear excepted.

b. Violate Blue Sky Vacation Rentals (BSVR) policies and procedures generally and “house rules” in particular.

c.  Fail to place debris and rubbish in waste baskets during your stay and, upon departure, empty trash to designated refuse-garbage located in Condo units near elevators, Homes in garage or side of building. Please see note & directions in green binders. Also, failure to clean soiled dishes- pots & pans prior to leaving.

d.  Lose keys or leave the residence unlocked upon departure. We request that all applicable unit keys/access cards/parking passes are left on Kitchen counter upon departure and photo is sent via text to 802-265-1210. 

e.  Fail to pay charges that have accrued during the stay (e.g., pay-per-view movies);

f.   Lose or damage linens.

g.  Check-in early or check-out late without prior permission.

h.   You overheat the property using an excessive amount of propane gas (the tank is checked before and after each stay). This only applies to Homes.

i. Fail to remove any food items that you may have brought with you or place them in the garbage. 

You will be notified if Blue Sky Vacation Rentals (BSVR) intends to assess damages or fines. BSVR will charge the credit card on file for this stay and reserves the right to seek further legal action if the damage sustained exceeds the credit card limit.

5. MINIMUM AGE: All signatories to this Agreement and/or guarantors must be at least twenty-one (21) years of age and must be the one staying in the property.

6. FALSE INFORMATION: Any reservation obtained under false pretense will be subject to forfeiture of all payments made and the party will not be permitted to Check-in.

7.WRITTEN EXCEPTIONS: Any exceptions to the above-mentioned policies must be approved in writing in advance.

8. MAXIMUM OCCUPANCY: You must abide by the maximum occupancy limits of the property that you book, as listed in your guest portal. If you would like to host additional guests ‒ up to the maximum occupancy for this home ‒ please reach out to Blue Sky Vacation Rentals for more information. If additional guests are permitted, additional fees and protocols will need to be reviewed with you.  For any such guests, you are more than welcome to bring blow-up mattresses (if desired) and will also need to bring your own sheets, blankets, pillows, towels, and washcloths.

If you exceed the maximum occupancy at any point during your stay, you will be removed from the property and a penalty in an amount of $1000 will be charged to the credit card on file for each person above the maximum number.

9. CHECK IN/CHECK OUT TIMES: On the day of your arrival, Guests may Check-in at 04:00 PM EST. On the day of departure check-out time is 10:00 AM EST. Requests for Early Check-in or late check-out requires Blue Sky Vacation Rentals (BSVR) prior approval. BSVR reserves the right to charge a late Check-out fee of $50 per 30-minute interval past the Check-out time. 

10. NO SMOKING: All buildings and homes are NON-SMOKING. Smoking inside of the home will result in a $500 fine.

11. PETS: Some Blue Sky Vacation Rentals (BSVR) properties allow pets while others do not. You will be required to honor the applicable pet policy. Both policies are included for your review and signature. Please verify with a BSVR representative if you are unsure which policy applies to the home that you are renting.

12. LOST ITEMS: If anyone in your group leaves an item behind, we are happy to facilitate its return to you as soon as practical.  The fee for this service is $35.00 together with actual shipping charges. Unless other arrangements are made, we use the card on file for this. Any items that remain unclaimed for thirty (30) or more days are disposed of.

13. INSECTS AND OTHER CREATURES: Our homes are cleaned and disinfected to the highest degree, and we strive, to the extent possible, to keep our homes free of insects and other pests

Bears, fox, mice, bats and other “varmints” are a fact of mountain life and, on rare occasions, may find their way around our homes.  Although Blue Sky Vacation Rentals and its owners are proactive in taking measures to avoid such intrusions, no system is perfect. If one of these unanticipated guests arrives during your stay, please notify BSVR and we will take appropriate steps to rectify the situation.

The appearance in the home of these insect and creatures has nothing to do with the home’s “cleanliness” and, accordingly, neither Blue Sky Vacation Rentals (BSVR) nor the owners may be held responsible ‒ nor any refunds given ‒ if they appear during your stay. 

14. MAINTENANCE ISSUES: Blue Sky Vacation Rentals (BSVR) and the owner of the home are required to deliver the Property to you in a fit and habitable condition. With the notable exception of “Mandatory Evacuations/Travel Restrictions,” discussed in earlier, if the home is not in that condition at the time you are to begin occupying the property, at its election, BSVR will either substitute a reasonably comparable property or refund your payments.

Moreover, although Blue Sky Vacation Rentals (BSVR) spends a great deal of time and effort ensuring the integrity and upkeep of all the systems in all of our homes, sometimes “things break.”  When this occurs, BSVR will make every effort to correct the situation, and/or make your stay as comfortable as possible under the circumstances. Neither BSVR nor the homeowner may be held responsible for any “system” breakdown including, but not limited to, any appliances or amenities such as pools and hot tubs. 

15. MANDATORY EVACUATIONS/TRAVEL RESTRICTIONS: If state or local authorities order a mandatory evacuation of, or impose restrictions on travel into, an area that includes this home, you must comply with the order whether or not you are already in possession of the property.  Under either circumstance, you are not entitled to a refund either from BSVR or the Owner.  This is because you have been offered trip insurance that, if purchased, would compensate you for losses or damages resulting from loss of use of the property due to a mandatory evacuation order or travel restriction.  Of course, if you have purchased the trip insurance, you can submit your claims directly to Rental Guardian Travel Insurance.

16. STORM POLICY/ROAD CONDITIONS: In the event of inclement weather, Blue Sky Vacation Rentals (BSVR) will make every effort to ensure the home is accessible for your stay; however, no refunds are given for storms or other “natural events” or “natural disasters” (e.g., blizzards or hurricanes) provided the home itself remains fit and habitable.  Nor do we issue refunds due to road conditions or other effects from storms or other events. Mountain roads are often both curvy and steep, and can become icy, so please be careful under these conditions.  Again, we strongly recommend you purchase travel insurance to avoid an unnecessary loss of your vacation investment.

17. EXPEDITED EVICTION: Our Rental Agreement is a short stay- right to use, upon checkout date if party does not depart, we reserve the right to contact local law authorities and have you removed as trespassers. For long term over 30 nights, we reserve the right to charge 5 x the nightly rate for each stay beyond departure date. 

18. LIABILITY WAIVERS: This home does/does not include various features and amenities for which we require liability waivers. These items typically include pools, hot tubs, lakes, the ski slopes, hiking trails, playgrounds, mountain biking trails, fragile furnishings, natural areas, wildlife areas, and general outdoor areas where caution should be always exercised. Any of the applicable waivers are included for your review and signature.

19. NEIGHBORHOOD: Some of our homes are within private communities or in the Stratton Resort Property which enforce their own rules and regulations. All of these regulations are included for your review and signature. Please drive slowly, be polite and courteous, and keep noise and such to a minimum. Unacceptable behavior will be met with possible eviction. If the home you book is within one of these communities, you may be required to fill out and sign additional forms upon booking. These forms are also listed below for your review. Quiet Hours are from 10 PM to 7 AM. Pool & Hot Tub area in Condo area are closed at these times as well. 

20. FIREARMS and Fireworks: Guns are not permitted at any of our Blue Sky Vacation Rentals properties. Use of firearms or any incendiary or explosive device is expressly prohibited on the Property, and any violation of this may result in the imposition of fines up to $500.00, and immediate eviction from the premises, with full forfeiture of any remaining nights and NO refunds. Any discharge of fireworks and/or firearm may additionally involve the local police and the institution of civil and/or criminal proceedings.  

21. SECURITY CAMERAS: There are security cameras placed around the exterior of some properties. The video is for security purposes only and will not be used for personal use or marketing purposes.

22. OUTSIDE VENDORS: If you intend to bring any outside vendors onto the property during your stay (photographer, chef, etc); they must first be authorized by Blue Sky Vacation Rentals (BSVR). We must receive a Certificate of Insurance from them as well, for liability purposes. There may also be additional charges involved.

23. PARKING: Guest must abide by the parking guidelines provided in your guest portal or rental agreement- each property has at least one (1) reserved designated parking space- area. Guests need to park in this space and cars are subject to being towed at the owner’s expense.

24. TECHNICAL ISSUES: Due to rare technical issues, all online rates and reservations are not final until approved by Blue Sky Vacation Rentals.    

25. CHANGE OF PROPERTY MANAGER: Blue Sky Vacation Rentals (BSVR) represents the home on the owner’s behalf pursuant to a separate property management agreement between BSVR and the owner.  That agreement is subject to change and/or cancellation at any time. If that change/cancellation occurs, both you and the owner remain legally obligated to honor the terms and conditions of this agreement.  In other words, a change in management does not nullify any terms of this Agreement.

26. MOLD / MILDEW: Mold and mildew are as old as any recorded/identified living organism.  Both feed on moisture, so bathrooms, showers, laundry rooms, kitchens and other areas are where mold can incubate and grow. Blue Sky Vacation rentals cleaning staff looks for this and in rare occasion that we find this on shower curtains or bath areas we correct this.  That being said the issue being properly addressed by BSVR’s cleaners, mold can and may appear during your stay ‒ its presence does not imply a “dirty,” unclean, or non-disinfected property, nor is it likely to be toxic.  If it does appear during your stay, please contact us and we will take care of it as soon as practical.  The mere presence of harmless mold/mildew does not serve as grounds for a refund of your vacation rental fee.

27. EXTENDED STAYS: Stays extending more than ten (10) days require interim trash pick-ups (at 10-day intervals), the charge for which ‒ currently $45.00 per pickup ‒ will be calculated at the time the reservation is booked.  Stays exceeding thirty (30) days will require monthly inspections and housekeeping, the charge for which will be calculated at the time the reservation is booked. This only applies to homes (Mountain Light- Chalet O’Bear and River house). Condo units have refuse -garbage room where trash needs to be placed.

Acceptance

YOUR SIGNATURE ON THIS AGREEMENT, OR PAYMENT OF MONEY OR TAKING POSSESSION OF THE PROPERTY AFTER RECEIPT OF THE AGREEMENT, IS EVIDENCE OF YOUR ACCEPTANCE OF THE AGREEMENT AND YOUR INTENT TO USE THIS PROPERTY FOR A VACATION RENTAL.

By signing this document, you are submitting an electronic signature. Please carefully read the entire contract prior to submitting an electronic signature.

If you prefer to submit a written signature you may do so by printing this contract, signing each applicable page, and returning it, in full, to Blue Sky Vacation Rentals in one of the following ways:

NOTE: If you choose to send bank check payment via any method other than standard USPS mail (certified mail, FedEx, UPS, etc), please make prior arrangements to ensure your package is received appropriately.

Claims and/or Disputes

Any claim or dispute which may arise between the Guest (Contracting Party) and Blue Sky Vacation Rentals ( BSVR) (as legal representative of both BSVR and the Owners of the vacation rental) arising out of, or relating to, the Agreement or the breach thereof by either party, shall be addressed between the Guest and the Broker-in-Charge for BSVR. IF said claim or dispute cannot be agreeably settled, then the issue shall be decided by the governing courts through legal representation retained, separately by each party involved. However, all parties agree to 1st pursue settlement, with legal counsel if desired, through 3rd party mediation, mediator and location of mediation to be agreed upon by both parties. If initial mediation fails, prior to pursuing a trial, but after filing a lawsuit, both parties agree to again attempt 3rd party mediation. The failure of either party to exercise any rights granted hereunder shall not operate as a waiver of any of those rights. The laws of the State of Vermont will govern this Agreement for all Vermont rentals, and the laws in the state of New York will govern any legal issues with Costa Rica. 

Expedited Eviction Proceedings.

Grounds for eviction.
(a) Any guests/tenant who’s Right to Use – Rental Agreement- leases residential property subject to a vacation rental agreement under this Chapter for 30 days or less may be evicted and removed from the property in an expedited eviction proceeding brought by the Blue Sky Vacation Rentals ( BSVR)  or as agent for the landlord, as provided in this Article if the tenant does one of the following:
(1) Holds over possession after his or her tenancy has expired.
(2) Has committed a material breach of the terms of the vacation rental agreement that, according to the terms of the agreement, results in the termination of his or her tenancy.
(3) Fails to pay rent as required by the agreement.
(4) Has obtained possession of the property by fraud or misrepresentation.
(b) Only the right to possession shall be relevant in an expedited eviction proceeding. All other issues related to the rental of the residential property shall be presented in a separate civil action. 

Expedited eviction.
(a) Before commencing an expedited eviction proceeding, the landlord or real estate broker shall give the tenant at least four hours’ notice, either orally or in writing, (via email) to quit the premises. If reasonable efforts to personally give oral or written notice have failed, written notice may be given by posting the notice on the front door of the property.
(b) An expedited eviction proceeding shall commence with the filing of a complaint and issuance of summons in the county where the property is located. BSVR reserves the right to contact Stratton Properties Security and local sheriff depart to remove guests as trespassers.  (c) The complaint for expedited eviction shall allege and the property manager/ care taker,  landlord or real estate broker shall prove the following at the hearing:
(1) The vacation rental is for a term of 30 days or less.
(2) The tenant-guests entered into and accepted a vacation rental agreement that conforms to the provisions of this Chapter.
(3) The tenant-guests committed one or more of the acts listed in Rental Agreement a) as grounds for eviction.
(4) The landlord or real estate broker has given notice to the tenant to vacate as a result of the breach as provided in subsection (a) of this section.
The rules of evidence shall not apply in an expedited eviction proceeding, and the court shall allow any reasonably reliable and material statements, documents, or other exhibits to be admitted as evidence. The provisions of BSVR rental agreement, except any provisions regarding amount in controversy, shall apply to an expedited eviction proceeding held before the magistrate. These provisions shall not be construed to broaden the scope of an expedited eviction proceeding to issues other than the right to possession.
(d) If the court finds for the landlord or real estate broker, the court shall immediately enter a written order granting the landlord or real estate broker possession and stating the time when the guests shall vacate the property. In no case should this time be less than 1 hours or more than 8 hours after service of the order on the tenant. 

Violation of court order.
If a guest fails to remove personal property from a residential property subject to a vacation rental after the court has entered an order of eviction, the landlord or real estate broker shall have the same rights as provided in agreement to have our caretaker/ agent remove the guests property. The failure of a tenant or the guest of a tenant to vacate a residential property in accordance with a court order issued pursuant shall constitute a criminal trespass. 

Additional Waivers

The additional waivers below may or may not be applicable to your stay, depending on the home that you are staying in. If you would like to know which waivers apply to your stay, please ask a Blue Sky Vacation Rentals representative. We would be happy to provide you with that additional detail.

Pet Policy for Pet-Free Homes (if applicable):
By signing this agreement, you recognize and confirm that you have read all of the Rules and Regulations, but also have specifically read, understand, and will abide by the policies regarding NO pets. Specifically, that we have a “NO pets” policy, and that this policy is strictly enforced.

By agreeing to these terms and conditions, you understand and accept that you will be charged a $500 fee for any violations of this policy, and additionally, may be asked to leave the property if you violate this specific rule.

We have these policies in effect for our guests’ safety, hygiene, and well-being. Our goal is to provide a very luxurious, safe, and highly enjoyable experience for all of our guests, and we appreciate your cooperation and assistance.

Pet Policy for Pet Friendly Homes (if applicable):
By signing this agreement, you recognize and confirm that you have read all of the Rules and Regulations prior and following, but also have specifically read, understand, and will abide by the policies regarding pets. Specifically, that we have a “pets” policy, and that this policy is strictly enforced and outlined below.

1. Pets permitted are ONLY dogs, and they must be at least one (1) year old.
2. Pet Fee is set at $200/dog. 2 dogs per stay maximum. If you are bringing a pet, you are responsible for notifying us and providing payment.
3. All pets must comply with the following specifications.

a) Must be at least one (1) year of age or older;
b) Must be spayed or neutered;
c) Must be up to date on rabies vaccinations and all other vaccinations. 

4. Guest is responsible for cleaning up all pet refuse, on property and in neighborhood.
5. Pets are not allowed on furniture. Any evidence of pets on furniture may incur additional cleaning fees.
6. All pets are to be treated with a topical flea and tick repellent three (3) days prior to arrival. Fleas and ticks are rampant in this area and can cause harmful or fatal illness to both humans and pets.
7. Must not cause damage to premises or furnishings. If damages are caused, the total cost of the damage may be applied to the Security Deposit, with no limit.
8. Guest shall prevent pets from producing excessive noise at a level that disturbs the neighbors.
9. Pet(s) will not be left unattended for any undue length of time, either indoors or out. Pet will not be left unattended on the balcony, patio, or porch.
10. BSVR/Homeowner assumes no responsibility for illness or injury that may occur to either pets or humans while on the premises, or in the surrounding neighborhood. By signing this agreement, you understand and accept that you will be charged a minimum $500 fee for any violations of this policy, and additionally, may be asked to leave the property if you violate this specific rule.

We have these policies in effect for our guests’ safety, hygiene, and well-being. Our goal is to provide a very luxurious, safe, and highly enjoyable experience for all our guests, and we appreciate your cooperation and assistance.

Child Safety and Liability Waiver:
Guest specifically acknowledges that the property to be rented is decorated with “high end” furnishings and décor and has not been “child-proofed” and is not set up as specifically “child-friendly.”

If Guest chooses to bring a child, (or children), to the property, then Guest agrees to pay for any and all actual damages, if any, caused by such child. This includes any necessary repair and/or replacement of item if repair to a previous condition is not possible. The total cost of any such damages will still be the responsibility of the Guest.

Guest agrees to this condition and agrees to supervise any child at all times while in the home. Guest further agrees to hold Homeowner harmless and to indemnify Homeowner for any injuries to child while in and/or on the Property.

Pool- Hot Tub- Sauna Liability Waiver (if applicable):
Guest specifically acknowledges that the property to be rented has a swimming pool for use by guests, and that the use of the pool or Hot tub and surrounding area are at the guests “own risk”. Guests assume full responsibility and liability for usage of these facilities. 

If Guest chooses to bring a child, (or children), to the property, then Guest agrees to accept full responsibility for child’s safety. This includes use and access to the pool/hot tub/sauna areas. There are NO lifeguards on duty, and Guests are solely responsible for monitoring children and others at ALL times. The Owner and BSVR accept NO responsibility for anyone’s safety, nor liability for misuse or accidents.

Guest agrees to all these conditions and agrees to supervise any child or others at all times while staying at the home. Guest further agrees to hold Homeowner and BSVR harmless, and to indemnify Homeowner and BSVR for any injuries to anyone while using the pool-hot tub-sauna area, and in the home and/or on the Property.

Any such damage exceeding the Security Deposit will still be the responsibility of the Guest.

Fireplace- Fire Pit Liability Waiver (if applicable):
Guest specifically acknowledges that the property to be rented has a wood fire place and fire pits for use by guests, and that the use of the fire place & fire pits and surrounding area are at the guests “own risk”. Guests assume full responsibility and liability for usage of these facilities.

If Guest chooses to bring a child, (or children), to the property, then Guest agrees to accept full responsibility for child’s safety. This includes use and access near the fireplace/ fire pit and surrounding areas. Guests are solely responsible for monitoring children and others at ALL times. The Owner and BSVR accept NO responsibility for anyone’s safety, nor liability for misuse or accidents.

Guest agrees to all these conditions and agrees to supervise any child or others at all times while staying at the home. Guest further agrees to hold Homeowner and Blue Sky Vacation Rental (BSVR) harmless, and to indemnify Homeowner and BSVR for any injuries to anyone while using or near any , and in the home and/or on the Property.

Additionally, Guest agrees to accept full responsibility for damages to trampoline and surrounding area. This includes any necessary repair and/or replacement of item if repair to a previous condition is not possible. Any such damages exceeding the Security Deposit will still be the responsibility of the Guest.

Playground Liability Waiver (if applicable):
Guest specifically acknowledges that the property to be rented has a playground for use by guests, and that the use of the playground and surrounding area are at the guests “own risk”. Guests assume full responsibility and liability for usage of these facilities.

If Guest chooses to bring a child, (or children), to the property, then Guest agrees to accept full responsibility for child’s safety. This includes use and access to the playground areas. Guests are solely responsible for monitoring children and others at ALL times. The Owner and BSVR accept NO responsibility for anyone’s safety, nor liability for misuse or accidents.

Guest agrees to all these conditions and agrees to supervise any child or others at all times while staying at the home. Guest further agrees to hold Homeowner and BSVR harmless, and to indemnify Homeowner and BSVR for any injuries to anyone while using the playground area, and in the home and/or on the Property.

Additionally, Guest agrees to accept full responsibility for damages to the playground area. This includes any necessary repair and/or replacement of item, if repair to previous condition is not possible. Any such damages exceeding the Security Deposit will still be the responsibility of the Guest.

Hot Tub Liability Waiver (if applicable):
Guest specifically acknowledges that the property to be rented has an above-ground hot tub for use by guests, and that the use of the hot tub and surrounding area are at the guests “own risk”. Guests assume full responsibility and liability for usage of these facilities. When not use, Guest is responsible for safety and avoidance of hot tub area by everyone staying or visiting home.

If Guest chooses to bring a child, (or children), to the property, then Guest agrees to accept full responsibility for child’s safety. This includes use and access to the hot tub. There are NO lifeguards on duty, and Guests are solely responsible for monitoring children and others at ALL times. The Owner and BSVR accept NO responsibility for anyone’s safety, nor liability for misuse or accidents.

Guest agrees to all these conditions and agrees to supervise any child or others at all times while staying at the home. Guest further agrees to hold Homeowner and BSVR harmless, and to indemnify Homeowner and BSVR for any injuries to anyone while using the hot tub, the hot tub area, and in the home and/or on the Property.

Additionally, Guest agrees to accept full responsibility for damages to the hot tub, equipment, and deck area. This includes any necessary repair and/or replacement of item if repair to a previous condition is not possible. The total cost of any such damages will be the responsibility of the Guest.

All guests are encouraged to shower and shampoo prior to entering the hot tub, and to avoid usage if they are experiencing any signs of illness, are carrying specific germs, or have open wounds. Hot tubs can be havens and incubators for germs due to the temperature and inherent environment. BSVR and the owners accept NO responsibility for any illness, transmission of germs or otherwise related to, or the result of using the hot tub. (PLEASE NOTE: the hot tub is cleaned and serviced after every guest by a technician.  ( This is for all private homes) The Pool & Hot tubs at condo are cleaned and operated by Stratton Property management. 

Pool – Hot Tub Liability Waiver (if applicable):
Guest specifically acknowledges that the property to be rented has an in-ground swimming pool  and/or Hot tub for use by guests, and that the use of the pool and surrounding area are at the guests “own risk”. Guests assume full responsibility and liability for usage of these facilities. 

If Guest chooses to bring a child, (or children), to the property, then Guest agrees to accept full responsibility for child’s safety. This includes use and access to the swimming pool. There are NO lifeguards on duty, and Guests are solely responsible for monitoring children and others at ALL times. The Owner and BSVR accept NO responsibility for anyone’s safety, nor liability for misuse or accidents.

Guest agrees to all these conditions and agrees to supervise any child or others at all times while staying at the home. Guest further agrees to hold Homeowner and BSVR harmless, and to indemnify Homeowner and BSVR for any injuries to anyone while using the pool, the pool area, and in the home and/or on the Property.

Additionally, Guest agrees to accept full responsibility for damages to the pool, equipment, and deck area. This includes any necessary repair and/or replacement of item, if repair to previous condition is not possible. The total cost of any such damages will still be the responsibility of the Guest.

Bunk Bed Liability Waiver (if applicable):

Guest specifically acknowledges that the property to be rented has bunk beds for use by guests, and that the use of the bunk bed and surrounding area are at the guests’ “own risk”. Guests assume full responsibility and liability for usage of these facilities.

If Guest chooses to bring a child, (or children), to the property, then Guest agrees to accept full responsibility for child’s safety. This includes use and access to the bunk beds. Guests are solely responsible for monitoring children and others at ALL times. The Owner and BSVR accept NO responsibility for anyone’s safety, nor liability for misuse or accidents.

Guest agrees to all these conditions and agrees to supervise any child or others at all times while staying at the home. Guest further agrees to hold Homeowner and BSVR harmless, and to indemnify Homeowner and BSVR for any injuries to anyone while using the bunk beds, surrounding area, and in the home and/or on the Property.

Additionally, Guest agrees to accept full responsibility for damages to the bunk beds. This includes any necessary repair and/or replacement of item, if repair to previous condition is not possible. The total cost of any such damages will still be the responsibility of the Guest.

Amenity & Outdoor Equipment Liability Waiver (if applicable): 
Guest specifically acknowledges that the property to be rented has outdoor amenities and equipment for outdoor activities, and that the use of these are at the guests “own risk”.  Guests assume full responsibility and liability for usage of these amenities and equipment.  

If Guest chooses to bring a child, (or children), to the property, then Guest agrees to accept full responsibility for child’s safety.  This includes use and access to the outdoor amenities and equipment for outdoor activities. Guests are always solely responsible for monitoring children and others.  The Owner and BSVR accept NO responsibility for anyone’s safety, nor liability for misuse or accidents.  

Guest agrees to all these conditions and agrees to supervise any child or others at all times while staying at the home. Guest further agrees to hold Homeowner & BSVR harmless, and to indemnify Homeowner & BSVR for any injuries to anyone while using the outdoor amenities and equipment for outdoor activities, and in the home &/or on the Property.   

Additionally, Guest agrees to accept full responsibility for damages to the outdoor amenities and equipment for outdoor activities.  This includes any necessary repair and/or replacement of item, if repair to previous condition is not possible. The total cost of any such damages will still be the responsibility of the Guest.

Property Liability Waiver (if applicable):
Guest specifically acknowledges that the property to be rented has acreage for hiking and exploring, and that the use of this acreage is at the guests “own risk”. These areas are perfect for enjoying nature, but this does come with some risk. The grounds may be uneven or even blocked by fallen limbs, etc. This could result in injury such as sprained ankles and other possible injuries. Animals also live in these woods, so be cautious of any snakes, bears, etc. Guests assume full responsibility and liability for usage of these facilities.

If Guest chooses to bring a child, (or children), to the property, then Guest agrees to accept full responsibility for child’s safety. This includes use and access to the acreage. Guests are solely responsible for monitoring children and others at ALL times. The Owner and BSVR accept NO responsibility for anyone’s safety, nor liability for misuse or accidents.

Guest agrees to all these conditions and agrees to supervise any child or others at all times while staying at the home. Guest further agrees to hold Homeowner and BSVR harmless, and to indemnify Homeowner and BSVRfor any injuries to anyone while using the acreage, and in the home and/or on the Property.

Residential Area (if applicable):
Your experience is our top priority; in concert with this is our relationship, we also take our relationship with the neighbors and home owners very seriously. While we ask that you respect the owner’s home, property and possessions available for your use during your stay, we also remind you to respect the neighbors in the community as they are also allowing you to visit. This home is in a residential area with neighboring homes, so please keep that in mind at all times, and respect the quiet and privacy of the neighbors.

To that end, please observe the following rules:
1. Out of respect to neighbors, do not gather outside of the property after 11 pm on weekend evenings (Friday, Saturday and before federal holidays) or after 10 pm on weeknights (Sunday through Thursday, aside from federal holidays). No one should congregate on the front porch, yard, driveway or in the garage with the garage doors open after this time.
2. All vehicles must be parked in the driveway. Please do not park on the street. The street is a private road maintained by the homeowner’s association. You may use it only to access the property.
3. No more than the maximum occupancy are allowed on the property at any time unless you receive express written permission from BSVR to allow an exception. No third parties (people not staying at the property as guests) are allowed without express written permission.
4. Do not wander around or explore the neighborhood or the woods. Property lines are not clearly defined and trespassing onto neighbors’ yards is not permitted.
5. Be considerate of the volume of music at all hours, especially when outside.
6. Maintain general courtesy for neighbors on their property or walking or driving around.

In efforts to ensure that you have a great time, if a complaint is made to BSVR, we will notify you immediately; however, the neighbors do have the right to involve the authorities if they deem necessary. Reports of excess noise may be considered breach of contract and you may be subject to expedited eviction proceedings. Again, we share all of this only to ensure that you have a spectacular, uninterrupted stay with us. Thank you!

Rising Bear- Hearthstone- Long Trail and Landmark Lodges- Condominiums – RELEASE AND WAIVER OF LIABILITY AND INDEMNITY AGREEMENT (if applicable)

IN CONSIDERATION for being permitted to enter these Lodges /Condominiums and the common grounds of Stratton Mountain for vacation rental purposes, the undersigned, for himself/herself, his/her personal representatives, guests, children, heirs, and next of kin, acknowledges, agrees, and represents that he/she has or will immediately upon entering, and will continuously thereafter, thoroughly inspect such areas and his/her continued presence constitutes an acknowledgement that he/she has inspected the condominium, pool and hot tub, Sauna, area and the balance of the Stratton property and that he/she finds and accepts such areas as being safe and reasonably suited for the purposes of his/her use. He/she further agrees and warrants that if, at any time after entry, he/she finds anything to be unsafe or not reasonably suited, he/she and all guests and children will immediately leave the unsafe area and notify the appropriate parties.

The undersigned hereby RELEASES, WAIVES, DISCHARGES AND COVENANTS NOT TO SUE Blue Sky Vacation Rentals or  Owners Association, of the various  Lodge Condominium owners, or any of the officers, members, corporate representatives, managers, directors, employees, owners and lessees of the Blue Sky Vacation Rentals LLC.  Association, all for the purposes herein being collectively referred to as “released parties,” from all liability to the undersigned, guests, children, representatives, assigns, heirs and next of kin for any and all loss or damage, and any claim or demand therefore on account of injury to the person(s) or property or resulting in death of the undersigned or guests or children, whether caused by the negligence of the released parties or otherwise while in or upon any part of Blue Sky Vacation Rentals.

The undersigned hereby AGREES TO INDEMNIFY AND SAVE AND HOLD HARMLESS the released parties and each of them from any loss, liability, damage, or cost they may incur due to their presence in or upon BSVR and whether caused by the negligence of the released parties or otherwise.

WARNING: Use of the lake, kayaks, swimming pool, Hot Tubs, Sauna, grills, fire pits and/or fireplaces carry risks that may result in serious injury or death, and unsupervised use by children is prohibited. All persons must wear life vests (not provided) when in or around the lake. Elderly persons, pregnant women, young children (including infants) and anyone subject to heart disease, diabetes, low or high blood pressure, strokes, epilepsy or similar health issues should not enter the pool, hot tub, sauna or lake alone and without consulting their physician. Never enter the pool or lake, or use the kayaks, while under the influence of drugs or alcohol. Children must be supervised at all times to decrease risk of injury or drowning.

The undersigned hereby ASSUMES FULL PERSONAL RESPONSIBILITY FOR RISK OF BODILY INJURY,PROPERTY DAMAGE OR DEATH due to the negligence of the released parties or otherwise while in or upon BSVR The undersigned also represents, warrants and certifies that he/she and their guests have adequate insurance to cover any injury, illness or damage that may be caused or suffered while in or upon BSVR, or else agrees to bear the costs of such damage or injury. The undersigned further states that he/she and their children and guests have no medical conditions which would interfere with the use of the pool, lake, kayaks, or hiking, climbing stairs, etc.or else assume and bear the costs of all risks that may be created, directly or indirectly, by any such condition and expressly acknowledges such physical activities are dangerous and involve the risk of serious injury, death or property damage. The undersigned further expressly agrees that the foregoing releases, waivers, and indemnities are intended to be as broad and inclusive as is permitted under Vermont law and that if any provision is held invalid, it is agreed that the balance of this Agreement shall, notwithstanding, continue in full legal force and effect.

Any dispute, controversy or claim arising out of or related to this Agreement shall be settled by arbitration in accordance with the rules of the American Arbitration Association. The place of such arbitration shall be determined by the Board of Directors of the BSVR & Property Owners. 

THE UNDERSIGNED HAS READ, UNDERSTANDS THE RISKS, AND VOLUNTARILY SIGNS THIS RELEASEAND WAIVER OF LIABILITY AND INDEMNITY AGREEMENT and further agrees that no oral representations, statements, or inducements apart from the foregoing written agreement have been made.

RULES AND REGULATIONS FOR Stratton CONDOMINIUM RENTERS (if applicable)

These rules and regulations are a summary of the Declaration of Covenants,
Restrictions, Easements, Terms, Reservations, and Conditions for Stratton Lodges, Condominium and Rules and Regulations for the Rising Bear, Hearthstone & Long Trail Condominium Association, Inc. as established by the Developer of Stratton Property management, as they might pertain to the lessee of a condominium.

Pool Hours:

Pool Hours- Hot Tub- Sauna are from 9 am – 9 pm.

Common Areas:

Use of common areas (great room, pool table area, big screen TV, firepit, pond- ice skating area etc.) is from 9 am – 10 pm.
No music may be played in said space before 9 am or after 9 pm.

Noise:

BE RESPECTFUL OF YOUR NEIGHBORS AT ALL TIMES.
We ask that your respect quiet hours in the lodge, the lodge common areas, and the condominiums is from 7 pm – 8 am.

Security:

Renters are issued a temporary key fob that they may use to enter the lodge. Do not prop open or leave the exterior doors open at any time. Do not open the exterior doors for anyone. Anyone that has access to the lodge will have a key fob. At end of stay please leave access cards, key fobs and /or keys on kitchen counter.

Smoking:

There is no smoking or the use of tobacco products in the lodge, or in the units, or in the pool area at any time.

Pets:

Renters are not allowed to have pets of any kind in the Pool- Hot tub at any time.

Children:

Children must be accompanied by an adult in the common areas of the lodge, the common areas of Rising Bear, Hearthstone & Long Trail, and the pool- Hot tub areas.

Amenities:

Please enjoy and respect the amenities of Stratton by leaving the area as you found it.

Parking:

All cars should park in the parking space designated for them, if an extra car is needed parking is allowed near base of Stratton – where there are no signs posted that state reserved for Landmark. There is a designated parking space for each condominium unit, in addition to a handicap parking space. Please Park in your assigned space only.

Balcony Use:

Occupants are not permitted to hang bathing suits, life jackets, beach blankets, towels or anything over the balcony or walkway railings.

Grill/Outdoor Cooking:

No grilling or outdoor cooking of food is permitted on any condominium balcony or terrace. From Memorial Day thru Columbus Day- Hearthstone, Rising Bear and Founders do have designated gas BBQ grill for guests usage, in addition several of our homes have BBQ grill as well, Summer to Fall season.   

Cancelation Policy Review

CANCELATIONS*: Our cancellation policy works in three phases:
Phase 1: Cancelations that are made more than sixty-one (61) days prior to the arrival date will be eligible for a full refund, less the processing fee and a $95.00 service charge.
Phase 2: Cancelations or changes that result in a shortened stay, that are made within sixty (60) to thirty-one (31) days of the arrival date, forfeit the initial 50% payment.
Phase 3: Cancelations or changes that result in a shortened stay, made within thirty (30) days of the arrival date will forfeit all payments. Early departure does not warrant a refund of rent*. We strongly recommend adding travel insurance to cover your investment from unforeseen circumstances.
